Capital Murder Trial – Death Penalty Avoided After Seven Years of Litigation
Attorney Jerome Stone of Stone & Capobianco, P.L. served as part of the defense team representing Amir Tafari Muhammad in a complex capital murder prosecution in the Nineteenth Judicial Circuit in St. Lucie County, Florida. Mr. Muhammad was charged with First-degree Murder with a Firearm, one of the most serious offenses under Florida law and a charge that exposed him to the death penalty.
The case involved more than seven years of litigation, beginning with the filing of charges in 2019 and concluding with a jury trial in early 2026. Attorney Stone worked alongside co-counsel Thomas Burns and Karen Tufte as part of the defense team, devoting years to investigation, motion practice, witness preparation, and the development of mitigation evidence in anticipation of both the guilt phase and potential capital sentencing proceedings.
The matter ultimately proceeded to a lengthy jury trial lasting approximately one month, during which the defense team vigorously advocated on behalf of their client through cross-examination of witnesses, presentation of defense evidence, and careful preparation for the penalty phase of the trial.
Following the jury’s verdict finding Mr. Muhammad guilty of first-degree murder, the case proceeded to the capital sentencing phase, where the jury was tasked with determining whether the appropriate sentence would be death or life imprisonment without the possibility of parole.
After hearing mitigation evidence and argument from counsel, the jury recommended a sentence of life imprisonment rather than death, thereby sparing Mr. Muhammad from the death penalty. The court subsequently imposed a sentence of life imprisonment without the possibility of parole, consistent with the jury’s recommendation.
